Auction conditions Select Sale

  1. Organizer and purchase contract:
    The European Breeders Trust AG (hereinafter referred to as "Organizer") organizes the online and live auction and sells the horses in the name and on the account of the seller. Purchase contracts come exclusively between the seller and the highest bidder. By participating in the auction, whether on site or online, the bidder agrees to the auction rules. All information about the auction horses is provided to the best of our knowledge. However, the organizer assumes no liability for the correctness of the information. Errors or misunderstandings do not entitle the highest bidder to resign because the buyer was given enough time to check the horse.

  2. Registration and export:
    The organizer guarantees that all the horses offered meet the registration criteria of the World Arabian Horse Organization (Waho). The buyer bears the costs for the export certificate and export fees in the land of the buyer.

  3. Veterinary examination and health certificate:
    Each horse is examined by a veterinarian before the auction and receives a health certificate. An ultrasound examination is carried out for pregnant mares, the result of which is noted in the health certificate. A copy of the health certificate can be viewed before the auction. On the day of the handover, each horse receives the necessary veterinary certificates for the country of destination. The buyer bears the cost of this certificate and transport to the destination. The organizer assumes no liability for later health complications such as miscarriages.

  4. Currency:
    All bids are submitted in euros (€).

  5. Booting errors and disputes:
    The organizer is not liable for bid errors. Doubts about the validity of the highest bid must be reported immediately. The organizer can open and continue the bid, even if the purchase contract has already been signed. Disputes during the auction are decided by the organizer. This decision is binding for all parties and not contestable. Examples of disputes are: several equal bids, misunderstandings about the allocation or technical problems. The organizer has the right to reject bids or offer the lot again. The auctioneer's decision is final and incontestable.

  6. Resignation of the buyer:
    If the buyer does not confirm the purchase (e.g. by not signing the sales display or revocation of the sales confirmation by email at online offers), the horse can be auctioned again. The original buyer is liable for possible revenue losses.

  7. Purchase price, commission and taxes:
    The purchase price is made up of the award price and a commission of 9%, plus the statutory VAT of 19%. VAT is reimbursed for buyers with a valid EU sales tax identification number, which can demonstrate the intra-community transport of the bought horse. The prerequisite is that the export procedure was started in Germany and is concluded within three months of full payment.

  8. Risk transfer and transfer of ownership:
    With the contract, the buyer takes over full responsibility for the horse. From this point on, no contradictions are no longer permitted. The horses are sold in the state in which they were presented at the auction. Any claims are to be addressed directly to the previous owner. The organizer assumes no liability. The transfer of ownership only takes place after the purchase price is paid in full.

  9. Cost by surcharge:
    After the contract, the buyer assumes all costs, such as transport, accommodation, veterinary fees and farrier. The buyer is responsible for the stable and supply of the horse from the time of the surcharge until collection.

  10. Payment:
    Payment of the purchase price must be made immediately after purchase in cash or by bank transfer. The organizer is entitled to accept the payment and to take legal action against the buyer in the event of a delay in payment. The organizer is only liable for intent or gross negligence.

  11. Collection of horses:
    The horses purchased must be picked up by October 30, 2024 at the latest. If not in good time, the buyer bears the warehouse and supply costs.

  12. Handover:
    The horses are only handed over after full payment. A handover takes place only after the purchase price is paid in full.

  13. Transport:
    The transport of the horses purchased can be conveyed on request. After full payment, the horses will be brought back to their stable at the buyer's expense, unless the buyer organizes his own transport. In this case, the horse must be picked up by 12:00 p.m. on September 30, 2024 at the latest.

  14. Program changes:
    The organizer reserves the right to change the course of the auction. This includes the right to auction horses together, separated or not at all.

  15. Insurance:
    Horses are not automatically insured according to the contract. On request, life insurance can be taken out via our partner Jarvis Insurance. Representatives of Jarvis Insurance are available on site to advise buyers.

  16. Calculation and place of jurisdiction:
    These auction conditions and all the resulting claims are subject to German law. The place of jurisdiction is Kempten, Germany. In the event of a legal dispute, the observing party is entitled to claim reasonable lawyers and court costs.

 

Auction conditions Silent Sale:

  1. Organizer and purchase contract:
    The European Breeders Trust AG (hereinafter referred to as "Organizer") organizes the online and live auction and acts on behalf of the seller. Purchase contracts come exclusively between the seller and the highest bidder. With participation in the auction, be it on site or online, the bidder agrees to the auction rules. All information about the auction horses is provided to the best of our knowledge; However, the organizer assumes no liability for the correctness of the information. Errors or misunderstandings do not entitle the highest bidder to withdraw from the purchase, since there was enough time to check the horse.

  2. Registration and export:
    All horses offered correspond to the registration criteria of the World Arabian Horse Organization (Waho). The buyer bears the costs for the export certificate and any export fees.

  3. Veterinary examination and health certificate:
    Each horse is examined by a veterinarian before the auction and receives a health certificate. In pregnant mares, an ultrasound examination is carried out, the result of which is noted in the health certificate. This document can be viewed before the auction. The necessary veterinary certificates for export are issued on the day of the handover. The buyer bears the cost of the certificate and transport to the destination. The organizer assumes no liability for later health problems, such as miscarriages.

    The organizer assumes no responsibility for bid errors. Disputes about the highest bid must be reported immediately. The organizer bindingly decides on the unclears, e.g. B. with several equally high bids, misunderstandings or technical problems. This decision is final and not contestable. The organizer reserves the right to reject bids at his own discretion. In the event of disputes between several bidders, the bid registered in the online system is recognized as valid.

  6. Minimum bidding and bidding:
    The highest bid is awarded the contract. The remaining bidding is displayed both online and live. If a higher bid is given within the last two minutes before the expiry of the bidding, the bidding period automatically extends by two minutes. This new closing time is displayed both online and live.

  7. Resignation of the buyer:
    If the buyer does not confirm the purchase (e.g. by not signing the purchase contract or withdrawal by email at online offering), the horse can be auctioned again. The original buyer is liable for any revenue losses.

  8. Purchase price, commission and taxes:
    The purchase price consists of the award price plus a commission of 9% and the statutory VAT of 19%. Buyers with a valid EU sales tax identification number that proves the intra-Community transport of the horse can be reimbursed for VAT, provided that the export procedure is completed within three months of full payment.

    All costs incurred after the contract, such as transport, accommodation, veterinary costs and farrier, are at the expense of the buyer. The buyer is obliged to ensure the supply and accommodation of the horse until collection.

  11. Payment:
    Payment of the purchase price must be made immediately after purchase in cash or by bank transfer. The organizer is entitled to receive the payment and, in the event of non -payment, to take legal action against the buyer. The organizer is only liable for gross negligence or intent.

  12. Collection of horses:
    The horses purchased must be picked up by October 30, 2024 at the latest. Otherwise, warehouse and supply costs that the buyer have to bear may incur.

  13. Handover:
    The horses are only handed over after full payment. No handover is possible without full payment.

  14. Transport:
    The transport of the horses can be conveyed on request. Alternatively, the buyer can arrange his own transport. In this case, the horse must be picked up on September 30, 2024 by 12:00 p.m. at the latest.

  15. Program changes:
    The organizer reserves the right to change the course of the auction, including the decision to have horses together, separated or not at all.

  16. Insurance:
    Horses are not automatically insured according to the contract. Life insurance can be taught via our partner Jarvis Insurance on request. Representatives of Jarvis Insurance are available on site to advise buyers on the insurance opportunities.

  17. Calculation and place of jurisdiction:
    These auction conditions and all the resulting claims are subject to German law. The place of jurisdiction is Kempten, Germany. In the event of a legal dispute, the observing party is entitled to the reimbursement of reasonable attorney and court costs.

 

Auction conditions and conditions Embryo Sale:

 

  1. Organizer and purchase contract:
    The European Breeders Trust AG (hereinafter referred to as "Organizer") organizes the online and live auction and sells the embryos or embryo rights named on the Internet in the name and on the account of the donor mare's owner. Purchase contracts are concluded exclusively between the seller (owner of the mare) and the highest bidder. By participating in the auction, whether online or live, the bidder explains his consent with the auction conditions. All information about the embryos offered is provided to the best of our knowledge. However, the organizer assumes no liability for the correctness of the information on the Internet or other information. Errors do not entitle the highest bidder to withdraw from his obligation to buy because the buyer was given enough time to find out about the lot.

  2. Registration and export of the embryo:
    The organizer guarantees that all the embryos offered meet the registration criteria of the World Arabian Horse Organization (Waho). All costs for the extraction of the embryo, the transport, the accommodation of the donor and recipient mare as well as the registration of the embryo and the export certificate to the buyer's land must be borne by the buyer.

  3. Bid currency:
    All bids are submitted in euros (€).

  4. Bidding errors and disputes:
    The organizer is not liable for errors during the area. Doubts about the validity of the highest bid must be reported immediately. The organizer can reopen and continue the auction at his own discretion, even if the purchase contract has already been signed. Disputes that occur during the auction are decided by the organizer. This decision is binding for all parties and is not entitled to compensation or cost equalization claims. Examples of such disputes are: two or more commandments for the surcharge of an embryo, misunderstandings regarding the allocation, obvious mistakes by the organizer or technical problems with online commandments. The organizer has the right to reject bids at his own discretion. In the event of disputes between two or more bidders, the auctioneer can decide to offer the lot again. The auctioneer's decision is final and binding.

  5. Resignation of the buyer:
    If the buyer objects to the sales confirmation or does not submit it, the embryo can be auctioned again. In this case, the original buyer is liable for possible losses of the proceeds.

  6. Purchase price, commission and taxes:
    The purchase price is made up of the award price and a commission of 9%. There are no further fees on the part of the organizer, but the buyer bears all costs for the production of the embryo. In addition, the purchase price is increased by the currently valid VAT (VAT) of 19%. Buyers with a valid EU sales tax identification number that demonstrate the intra-Community transport of the embryo are freed from the payment of VAT. Buyers who present the necessary export documents confirm the export of the embryo from the European Union are also freed from VAT.

  7. Transfer of ownership:
    The ownership of the embryo passes to the buyer after the purchase price is paid in full. Until full payment, the embryo remains the property of the seller. Claims of the buyer do not entitle the purchase price or parts of it.

  8. Refund regulations:
    If an embryo that is younger than 42 days is sold, the seller is obliged to reimburse 66% of the purchase price if the embryo is not confirmed by a veterinarian in the recipient mare after 42 days.
    If an embryo law or a frozen embryo is sold and the seller cannot produce the embryo within 12 months, the seller also reimburses 66% of the purchase price. In both cases, the guarantee applies that the embryo must be confirmed by a veterinarian after 42 days.

  9. Payment and resignation of the seller:
    The purchase price must be paid within 10 working days according to the surcharge in cash or by bank transfer. If the buyer does not deposit the full purchase price within 4 weeks of the contract, the seller is entitled to withdraw from the sale. In this case, the buyer is liable for all damage and losses resulting, including a possible loss of the proceeds. The organizer is entitled to receive the payment and to take legal action against the buyer if the payment is not made. The organizer is only liable for intent or gross negligence.

  10. Program changes:
    The organizer reserves the right to change the course of the auction. This also includes the right to offer individual pilots together for auction, separate or not to auction it.

  11. Insurance:
    It is expressly recommended to insure the embryo in the recipient after confirmation by a veterinarian after 42 days in the recipient mare, as the seller's guarantee exposes from this point in time.

  12. Calculation and place of jurisdiction:
    These auction conditions as well as all the resulting complaints or actions are subject to German law. The place of jurisdiction is Kempten, Germany. The observing party has the right to request the reimbursement of the lawyers' fees, costs and expenses.
