Auction Terms – Online Breeding Auction
1. Organizer and Purchase Contract
European Breeders Trust AG (hereinafter "Organizer") organizes this online auction and sells the coverings designated on the website on behalf of and for the account of the respective stallion owners.
The purchase contract is concluded exclusively between the seller (stallion owner) and the highest bidder.
By placing a bid, the bidder acknowledges these auction terms as binding.
All information on the offered coverings is provided to the best of our knowledge and can be viewed via the “Show Contract” button for the respective Lot.
The organizer assumes no liability for the accuracy of the information. Errors do not entitle the buyer to withdraw, as every buyer is given sufficient opportunity to obtain information about the Lot.
2. Bid Currency
All bids are made in Euro (€).
3. Bidding Errors and Disputes
The organizer is not liable for errors during the bidding process.
Doubts about the validity of a bid must be reported immediately. The organizer may, at its discretion, reopen an auction—even after the auction has been awarded.
Disputes (e.g. identical bids, misunderstandings regarding the award, technical problems) are decided by the organizer. This decision is final and binding. It does not give rise to any claims for damages or reimbursement of costs.
The auctioneer is entitled to reject bids or to re-auction a Lot. His decision is final and incontestable.
4. Withdrawal by the Buyer
The buyer may exercise their statutory right of withdrawal if applicable in the individual case.
A withdrawal from the purchase contract after the auction has been awarded is generally excluded, unless there is a statutory reason for withdrawal.
5. Withdrawal by the Seller
If the full purchase price is not paid within 30 days after the award, the seller is entitled to withdraw from the contract.
In this case, the buyer is liable for all resulting damages and losses, especially for any possible shortfall in proceeds in the event of a new auction.
The organizer is entitled to accept payments and to take legal action in the event of payment default. The organizer is only liable in cases of intent or gross negligence.
6. Purchase Price and Taxes
The purchase price is composed as follows:

Hammer price

Plus statutory VAT (of the country in which the seller is resident)
No further fees will be charged by the organizer.
An exemption from VAT is possible if:

the buyer has a valid EU VAT ID and provides proof of intra-community transport, or
-
the buyer submits export documents confirming the export of the covering from the EU.
7. Use of the Covering
The use of the covering is only permitted after full payment.
Additionally, the covering conditions of the respective stallion owner apply, especially regarding shipping costs and veterinary services.
These conditions can be viewed at the respective Lot under “Show contract” and are accepted upon submission of the bid.
8. Discount Regulation
Individual discounts, as displayed on the website, will be deducted from the hammer price.
9. Payment
The purchase price must be paid in cash or by bank transfer within 30 days after the hammer.
All payments can be processed through the organizer.
10. Program Changes
The organizer reserves the right to change the course of the auction at any time.
This includes, in particular, the right to combine, separate, or withdraw Lots.
11. Choice of Law and Jurisdiction
Exclusively German law applies.
Place of jurisdiction is Kempten (Allgäu), Germany.
The prevailing party is entitled to claim reasonable attorney and court fees.
