Item

A covering by the stallion __________________________ is offered.
The basis for the buyer is the seller's breeding contract, which can be viewed on the website of the seller or stallion owner. This contract governs the conditions of the covering and is part of the offer.


1. Introduction

The organizer organizes auctions at which third parties (in particular breeders) can acquire or sell goods or rights - in particular horses, breeding rights, or embryo rights.
The owner/seller commissions the organizer, for remuneration, to auction the stated item. The purchase contract is concluded directly between the highest bidder and the owner/seller upon the fall of the hammer.


2. Services of the Organizer

2.1 Provision of a publicly accessible auction platform. The organizer does not become a contracting party.
2.2 Allocation of an individual lot to the seller.
2.3 The seller is given the opportunity to present live, as part of the auction, the stallion from which the offered covering originates.
2.4 To promote sales, the seller may present offspring of the stallion in order to demonstrate its hereditary qualities.
2.5 Possibility to play a video (max. 2 minutes) of the lot via the centrally installed video cube in the auction ring.
2.6 Two VIP tickets for the seller.
2.7 To promote sales, the following vouchers are offered to buyers:
a) 12% purchase voucher: For European breeders with EU citizenship and residence in Europe. Redeemable with partners according to the organizer's website.
b) 25% foal voucher: Applies upon the birth of a colt foal from the auctioned covering. Redeemable during the auction weekend in the year of birth.
c) 15% “consolation voucher”: For the bidder with the second-to-last bid on a sold lot. Redeemable with partners according to the website.
2.8 Promotion of the auction lots via social media and in the auction catalog.


3. Obligations of the Seller

3.1 Transfer of the full auction proceeds of the respective lot to the organizer as consideration for the services pursuant to section 2.
3.2 Proof of ownership upon request.
3.3 Submission of an official proof of identity.
3.4 Disclosure of any fiduciary relationships.
3.5 Right of termination of the organizer in the event of a breach or justified doubts.


4. Course of the Auction

4.1 Presentation of the lots with description and image material.
4.2 The contract language is German or English.
4.3 Start and end times will be announced in advance.
4.4 Starting bid: €1,000, bid increments shall be determined by the organizer.
4.5 Bids are binding.
4.6 The lot is awarded to the highest bidder.
4.7 Upon acceptance of the bid, the purchase contract is concluded directly between buyer and seller.


5. Reserve price

The reserve price corresponds to the starting bid in the amount of €1,000.


6. Advertising materials

6.1 Submission no later than 30 August 2026.
Formats:
 – Photos: JPEG, at least 300 dpi
 – Videos: MP4, at least 1920×1080, max. 2 minutes
6.2 The seller grants the organizer comprehensive, transferable rights of use in accordance with Sections 16–23 UrhG, including:
 6.2.1 Reproduction, distribution, publication, editing
 6.2.2 International use and transfer to third parties


7. Preparation and presentation of the lot

The seller bears sole responsibility and the costs for the preparation, care, and, if applicable, training of the presented stallion or offspring.


8. Warranty and indemnification

8.1 The seller guarantees lawful ownership of rights and legal compliance.
8.2 The seller shall fully indemnify the organizer against third-party claims.


9. Liability

9.1 The organizer shall be liable only in cases of intent, gross negligence, breach of essential contractual obligations, or under the Product Liability Act.
9.2 Liability is limited to the typically foreseeable damage.


10. Applicable law

German law shall apply exclusively. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.


11. Place of jurisdiction

The place of jurisdiction is – to the extent legally permissible – Kempten (Allgäu), Germany.
