Stallion Breeding Sale

Item

A covering of the stallion __________________________ is being offered.
The basis for the buyer is the covering contract of the seller, which can be viewed on the website of the seller or stallion holder. This contract regulates the conditions of the covering and is part of the offer.

1. Introduction

The organizer organizes auctions where third parties (especially breeders) can acquire or sell goods or rights – particularly horses, breeding rights, or embryo rights.
The owner/seller commissions the organizer for a fee to auction the mentioned item. The purchase contract is concluded directly between the highest bidder and the owner/seller with the acceptance of the bid.

2. Services of the Organizer

2.1 Provision of a publicly accessible auction platform. The organizer will not become a contracting party.
2.2 Allocation of an individual lot to the seller.
2.3 The seller is given the opportunity to present the stallion, from which the offered cover originates, live during the auction.
2.4 To promote sales, the seller may present offspring of the stallion to demonstrate its hereditary power.
2.5 Opportunity to display a video (max. 2 minutes) of the lot on the centrally mounted video cube in the auction ring.
2.6 Two VIP tickets for the seller.
2.7 To promote sales, the following vouchers are offered to buyers:
 a) 12% purchase voucher: For European breeders with EU citizenship and residence in Europe. Redeemable with partners listed on the organizer's website.
 b) 25% foal voucher: Valid upon the birth of a colt from the acquired cover. Redeemable at the auction weekend in the birth year.
 c) 15% "consolation voucher": For the bidder with the penultimate bid of an awarded lot. Redeemable with partners according to the website.
2.8 Promotion of auction lots via social media and in the auction catalog.

3. Obligations of the Seller

3.1 Remittance of the full auction proceeds of the respective lot to the organizer as consideration for the services according to clause 2.
3.2 Proof of ownership upon request.
3.3 Presentation of an official identity document.
3.4 Disclosure of any trust arrangements.
3.5 Right of termination by the organizer in case of breach or justified doubts.

4. Auction Process

4.1 Presentation of lots with description and image material.
4.2 Contract language is German or English.
4.3 Start and end times will be announced in advance.
4.4 Starting bid: 1,000 €, bid increments are determined by the organizer.
4.5 Bids are binding.
4.6 Award to the highest bidder.
4.7 Upon award, the purchase contract is concluded directly between the buyer and the seller.

5. Minimum Price

The minimum price corresponds to the starting bid of 1,000 €.

6. Advertising Materials

6.1 Submission by no later than August 30, 2025.
 Formats:
 – Photos: JPEG, min. 300 dpi
 – Videos: MP4, min. 1920×1080, max. 2 minutes
6.2 The seller grants the organizer comprehensive, transferable rights of use in accordance with §§ 16–23 UrhG, including:
 6.2.1 Reproduction, distribution, publication, editing
 6.2.2 International use and transfer to third parties

7. Preparation and Presentation of the Lot

The seller bears sole responsibility and costs for the preparation, care, and if necessary, training of the presented stallion or offspring.

8. Warranty and Indemnity

8.1 The seller guarantees lawful ownership and legal compliance.
8.2 The seller fully indemnifies the organizer against claims by third parties.

9. Liability

9.1 The organizer's liability exists only in cases of intent, gross negligence, breach of essential contractual obligations, or according to the Product Liability Act.
9.2 Liability is limited to the typically foreseeable damage.

10. Applicable Law

Exclusively German law applies. The UN Sales Law (CISG) is excluded.

11. Jurisdiction

Jurisdiction is – as far as legally permissible – Kempten (Allgäu), Germany.
