Contracting Parties

and the mare owner.

The mare owner acknowledges that the covering(s) are non-transferable and may not be resold to third parties.


FRESH SEMEN CONTRACT

(hereinafter referred to as Stable Operator)

Conditions for Fresh Semen:

The stable operator provides fresh semen from the stallion named in this contract, but does not guarantee the condition of the semen from the time of dispatch.

The mare owner is responsible for the proper handling of the semen as well as for the correct insemination of the mare.

The stable operator and its employees are not liable for improper handling of the semen and/or incorrect insemination of the mare.

The stable operator assumes no responsibility for delays in delivery by the courier service.
In case of loss or delay of the shipment by the courier, the mare owner is obliged to refuse a late delivery so that the stable operator cannot be held liable for the shipping costs.

If the mare owner nevertheless accepts a delayed delivery, the costs for semen collection and shipping are to be borne by the mare owner.

The costs for semen collection and health certificate are also to be borne by the mare owner if the shipment is lost or delayed.

All costs must be paid in full before the semen is dispatched, but only after an invoice has been issued.

Fees:

  • Fresh semen collection: 150.– €

  • Handling / Health certificate: 120.– € (only for shipping outside Germany)

  • Shipping costs: depending on destination

Invoices for semen collection and shipping are subject to the statutory VAT of 19%.

Semen collections take place on Mondays, Wednesdays and Thursdays.

Orders must be placed on the day of shipping no later than 9:00 a.m. exclusively via WhatsApp or by phone at the number above (Sabine Opderbeck).
Orders received later cannot be considered.

It is appreciated if the mare owner informs the stable operator a few days before the planned shipment.

The Frank Spönle Schautraining GmbH & Co. KG as the stable operator, as well as its representatives, employees, and veterinarians, are not liable for illnesses, theft, or injuries that the contracted mare and/or the resulting foal and/or the semen may suffer during the breeding period.


FURTHER CONTRACTUAL CONDITIONS

Important:
To facilitate the issuance of breeding certificates, the mare owner is obliged to inform the stallion owner immediately after confirmation of pregnancy.

If the mare does not conceive, aborts, or dies, the stallion owner guarantees the mare owner the right to a repeat covering or the exchange of the mare within the current or following breeding season.

The mare owner bears all costs associated with the production, handling, and shipment of the semen (production, handling, health certificate, and shipping).

The mare owner will be informed of the costs incurred prior to shipment.

If, for any reason, a mare does not conceive after two breeding seasons, the mare owner releases the stallion owner from any liability; in this case, the contract is considered fulfilled.

The breeding fee paid under this contract is fully earned and non-refundable.

If the mare does not give birth to a live foal or the foal dies within 45 days of birth, the mare owner must provide the stallion owner with a veterinary certificate within seven days of the death, indicating the birth, date and time of death, as well as the cause of death.

If the mare dies, the mare owner must provide the stallion manager with a veterinary death certificate.
