SERVICE CONTRACT FOR FRESH/FROZEN SEMEN – Contract No. …/2026
This contract concerns FRESH/FROZEN SEMEN from JS TROY, UELN 784001000022941, by DOMINIC M out of D GHANEEEMAH, and is entered into on …/…/2026 between the Giuseppe Vetrò Training Center, acting as representative/stallion manager of the Al Juwaher Arabians stud, hereinafter referred to as the “Stallion Owner”, and
............................................................................................,
hereinafter referred to as the “Mare Owner”.
THE PARTIES AGREE AS FOLLOWS:
The Al Juwaher Arabians stud, hereinafter referred to as the “Stallion Owner”, is the owner of the semen of JS TROY, hereinafter referred to as the “Stallion”.
Fresh/frozen semen from this stallion is available at the GIUSEPPE VETRÒ TRAINING CENTER.
The Mare Owner holds the lawful ownership rights to the mares listed below:
SEE APPENDIX PAGE 3
The Mare Owner undertakes to submit, together with this contract, a copy of the mare’s registration/pedigree papers.
In the event that the mare is boarded, a separate STC boarding contract must be signed by the mare’s keeper. All costs associated with boarding must be duly paid in accordance with the terms of this separate contract.
FEES
The stud fee for fresh/frozen semen of JS TROY € surcharge in the Aachen auction for 1 covering.
The stud fee guarantees the Mare Owner – subject to availability – sufficient fresh or frozen semen to carry out the covering.
If the Mare Owner decides to use frozen semen exclusively, two doses of frozen semen are included in the stud fee.
A dose of frozen semen is defined as a single insemination dose containing at least 600 million morphologically normal and motile spermatozoa. Depending on the semen quality, the number of 0.5 ml straws required for one dose will be provided.
A breeding certificate / Breeding Certificate will be issued once a pregnancy with heartbeat has been confirmed in the mare, all terms of this contract have been fulfilled, and all payments including service fees have been received in full.
All information required for the issuance of the breeding certificate must be provided by the Mare Owner via the insemination form (Insemination Form).
LIVE FOAL GUARANTEE (LFG)
This service contract includes a Live Foal Guarantee (LFG), provided that the mare is managed at a recognized insemination center.
If the mare does not become pregnant, the Mare Owner may order additional doses at a price of €300 per dose (plus any other fees not relating to the semen dose itself), up to a maximum of three doses.
If the mare fails to conceive, or if the resulting foal is unable to stand and nurse within 24 hours and dies, the mare owner is entitled to a rebreeding until a live foal has been produced.
An application for rebreeding must be accompanied within 7 days by a veterinary certificate regarding the reproductive status of the mare or the condition of the foal.
The mare owner confirms that the mare has been examined by a licensed veterinarian and found suitable for breeding.
If the mare named in this contract becomes ill, is injured, or is for other reasons unable to conceive a foal, the mare owner may substitute another mare with the prior written consent of the stallion owner.
The mare owner must notify the stallion manager within 60 days after the last insemination of the year if the mare has not become pregnant in order to be eligible for a rebreeding in the following year.
The mare owner must also notify the stallion manager within 30 days after an abortion by the mare.
The live foal guarantee is expressly contingent upon the mare owner having the mare vaccinated against EHV 1 and 4 in the 5th, 7th, and 9th month of pregnancy.
If the mare owner requests a rebreeding under this provision, they must provide the stallion manager with certification showing that these vaccinations were administered.
The live foal guarantee for the stallion shall be void, and the stallion owner and stallion manager shall have no further obligations under this section, if:
-
the mare owner does not provide proof of the EHV vaccinations;
-
the mare is replaced by another mare without the written consent of the stallion manager;
-
the mare does not become pregnant, miscarries, or dies, and the mare owner does not notify the stallion manager within the time limits set forth in this section.
By virtue of the live foal guarantee, this contract entitles the mare owner to ONE breeding and ONE breeding certificate for ONE foal.
All amounts paid by the mare owner are non-refundable, subject to the provisions of this contract under BREEDING and AVAILABILITY OF SEMEN, respectively.
JS TROY is CA, LFS, and SCID CLEAR (N/N).
In addition, the following fees apply and must be paid prior to the respective shipment:
All fees and costs incurred in connection with the care/insemination of the mare shall be borne by the mare owner.
Costs for collection and processing, tank filling, handling and preparation, dry shipper, shipping, health certificates, and tank transport are not yet included in this fee.
These fees can be found in the Reproduction Fee Schedule and the respective pro forma invoices and must be paid in advance BEFORE shipment.
BREEDING
The stallion manager reserves the right to require a bacteriological examination or biopsy of a mare that has not become pregnant after three estrous cycles in order to determine her suitability for breeding.
The Stallion Manager also reserves the right to refuse or discontinue further care/covering of a mare if an infectious and/or contagious disease is detected in the mare or if another objectively applicable reason exists.
In the event of such discontinuation of the service, the mare owner is required to use another mare in order to fulfill the terms of this contract.
FROZEN/FRESH SEMEN
The Stallion Manager makes fresh/frozen semen from the stallion specified in this contract available and assumes no further guarantee for the condition of the semen after it has left the semen storage facility or shipping facility.
The mare owner is responsible for the proper handling and storage of the semen as well as for the proper insemination of the mare.
Neither the stallion owner nor the stallion manager/agent shall be liable for semen that is lost, delivered late, or damaged.
The semen shipped to the mare owner becomes the property and sole responsibility of the mare owner.
The proper handling and storage of the frozen semen is exclusively the responsibility of the mare owner.
Unused frozen semen must be returned to the GIUSEPPE VETRÒ TRAINING CENTER.
AVAILABILITY OF FROZEN SEMEN
If the stallion dies, is sold, or is no longer available for any other reason, and if no semen (fresh or frozen) is still available, neither the stallion owner nor the stallion manager shall remain obligated to fulfill this contract.
All fees paid by the mare owner, including the stud fee, are non-refundable.
The mare owner expressly acknowledges that neither the stallion owner nor the stallion manager nor the semen storage/shipping facility makes any express or implied warranties regarding the fertility of the semen provided.
This contract constitutes the entire agreement between the parties and may only be amended by a written modification agreed upon and signed by all parties.
The parties declare that they have understood the terms set out in this contract and undertake to comply with them.
Executed in Alice Castello on …/…/2026 in 2 copies.
