§ 1 Subject Matter of the Contract
(1) This contract entitles the mare owner to a one-time use of a covering by the stallion FA EL RASHEEM for the mare designated above. A breeding certificate will be issued for the mare that is the subject of this contract.
2) The Breeding Right is personal and non-transferable. It may neither be sold, assigned, nor otherwise transferred to third parties. Any exception requires the prior written consent of Dubai Arabian Horse Stud.
(3) The Breeding Right is intended exclusively for the mare designated in the contract and the specified mare owner. Any transfer, assignment, or resale is permitted only with the prior written consent of the stallion owner.
(4) The insemination must take place within a maximum of three breeding seasons.
§ 2 Stud Fee and Costs
(1) The stud fee corresponds to the hammer price of the auction in Aachen.
(2) The stud fee must be paid in full in accordance with the auction and payment terms.
(3) All additional costs incurred, in particular for semen shipment, handling, transport, veterinary services, as well as any other costs arising in connection with the insemination, shall be borne by the mare owner.
§ 3 Live Foal Guarantee and Repeat Breeding
(1) The contract includes a guarantee of one live foal. A live foal is defined as a foal that survives at least 48 hours after birth. Upon expiry of these 48 hours, the obligation under this contract shall be deemed fulfilled.
(2) If the mare is not in foal after three estrous cycles, the stallion owner or their representative is entitled to require a veterinary examination, in particular a swab sample/culture or biopsy, to determine breeding soundness.
(3) If an infectious or contagious disease is present, the insemination may be refused. In this case, a suitable substitute mare must be designated with the prior consent of the stallion owner.
(4) If no pregnancy is achieved, the stallion owner must be informed in writing within 60 days after the end of the breeding season so that the claim to repeat breeding is preserved.
(5) If the mare that is the subject of the contract becomes ill, injured, or is no longer suitable for breeding for other reasons, a substitute mare may be used with the prior consent of the stallion owner.
(6) In the event of the mare’s death, a veterinary certificate must also be submitted.
§ 4 Twins
(1) If twins are detected, the stallion owner must be informed within 30 days.
(2) This contract generally covers only one live foal. The use of any additional breeding result arising from the same covering requires the prior consent of the stallion owner.
§ 5 Embryo Transfer
(1) If the Breeding Right is used for an embryo transfer, two doses of fresh semen are included. For each additional dose required beyond that, 300 USD plus any applicable handling and shipping costs will be charged.
(2) If two embryos are obtained during an embryo flush, this contract generally entitles the holder to use only one embryo.
(3) The use of the second embryo requires the prior consent of Dubai Arabian Horse Stud.
(4) If the mare owner wishes to retain and use the second embryo, an additional Breeding Right is required for this purpose. The acquisition of this additional Breeding Rights requires the consent of Dubai Arabian Horse Stud.
(5) If no additional Breeding Right is acquired and Dubai Arabian Horse Stud waives the second embryo, it must be discarded.
(6) If Dubai Arabian Horse Stud retains the second embryo, Dubai Arabian Horse Stud shall bear all costs of the recipient mare until pregnancy is confirmed on day 120. This includes in particular the costs for the recipient mare, veterinary services, boarding and care, as well as transport and shipping costs.
(7) If an additional Breeding Right for the second embryo is approved, Dubai Arabian Horse Stud must be informed of the pregnancy status of the second embryo on days 25, 60, and 120.
The provisions regarding a second embryo as well as the assumption of costs by Dubai Stud until the 120th day of pregnancy correspond to the underlying contract.
§ 6 Availability of Fresh and Frozen Semen
(1) If fresh or frozen semen is unavailable due to shortage, loss, or other unforeseen circumstances already before the first insemination of the mare that is the subject of the contract, the stud fee will be refunded in full.
(2) If the mare cannot be inseminated before the stallion departs from the respective breeding location, the mare owner shall receive two doses of frozen semen, regardless of whether fresh or frozen semen was originally intended.
(3) All handling and shipping costs for the frozen semen shall be borne by the mare owner.
(4) If the mare is not in foal after use of the two doses provided, additional doses will be charged at 300 USD per dose plus handling and shipping costs.
The two doses of frozen semen upon the stallion’s departure as well as the additional USD 300 for each further dose correspond to the original contract.
§ 7 Right of First Refusal
(1) Dubai Arabian Horse Stud receives a right of first purchase for the foal resulting from this mating:

(2) If the mare owner intends to sell the foal, Dubai Arabian Horse Stud must be informed in writing before any sale to third parties and shall be given the opportunity to purchase the foal on the terms agreed with the third party.
§ 8 Liability
(1) Dubai Arabian Horse Stud assumes no liability, to the extent permitted by law, for illness, injury, loss, or death of the mare or the foal, nor for loss of or damage to the semen in connection with the performance of this contract.
(2) Mandatory statutory liability provisions remain unaffected.
§ 9 Final Provisions
(1) This contract contains the agreements of the parties regarding the Breeding Right that is the subject matter of the contract.
(2) Amendments and additions to this contract must be made in writing and require the consent of both contracting parties.
(3) Should individual provisions of this contract be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
(4) The law of the United Arab Emirates shall apply.
