Breeding contract – Equiborn KA No. 2025

Breeding conditions for the stallion Equiborn KA

The breeding must be used before the end of the year 2027. After this deadline, the breeding will lose its validity.

1. Stud Fee

The breeding customer undertakes to pay the following fees:

  • Stud fee: € ____________

  • Each dose of fresh semen: €150.00 per insemination dose (max. 4 doses per season).

  • Each dose of frozen semen: €200.00 per dose (max. 4 doses per season).

Not included:

  • Transport costs and container rental.

  • All bank charges are to be borne by the mare owner.

The costs for semen and transport will be invoiced separately by the agent or clinic representing the stallion.

Important provisions:

  • Number of breedings: 1

  • Each covering entitles you to one covering certificate and one foal.

  • Definition of fresh semen dose: 1 billion sperm, at least 40% progressive motility.

  • Definition of frozen semen dose: min. 240 million progressively motile sperm, at least 30% motility after thawing (measured by CASA).

A covering certificate will be issued when:

  • the mare is pregnant,

  • a heartbeat has been detected, and

  • all payments have been made in full.

2. Live Foal Guarantee (LFG)

This contract includes a live foal guarantee within the period and provided the mare is managed at an approved insemination center.

Conditions:

  • If the mare aborts or the foal does not stand and nurse within 24 hours, there is a right to rebreeding within the contract period.

  • A veterinary certificate regarding the condition of the mare or foal must be submitted to Budhen’s Stud within 7 days.

  • The mare owner guarantees that the mare has been found suitable for breeding by a veterinarian.

  • Replacement with another mare only with the written consent of the stallion owner.

  • The stallion manager must be informed within 60 days after the last insemination if the mare is not pregnant.

  • Abortions must be reported within 30 days.

  • The LFG is tied to vaccination against EHV1,4 in the 5th, 7th, and 9th month of pregnancy (proof required).

The guarantee expires if:

  • no proof of vaccination is provided,

  • another mare is used without consent,

  • the mare does not become pregnant, aborts or dies and the stallion manager is not informed.

This contract entitles to one covering and one foal within the agreed period.

All payments are non-refundable.

3. General Conditions

a. The contract is not transferable without written consent from Budhen’s Stud.
b. Replacement of a mare only with written consent.
c. The stallion manager may require an examination of the mare or refuse the service if the mare does not become pregnant after 3 cycles or has a contagious disease.
d. The stallion manager provides fresh or frozen semen but does not guarantee its condition after leaving the shipping point.
e. Transport and storage are the responsibility of the mare owner.

Availability of semen:

  • If the stallion dies, is sold, or is unavailable, all obligations cease.

  • No refund of fees.

  • No guarantee for the fertilizing capacity of the semen.

4. Notifications

All notifications must be made in writing by registered mail.

5. Compliance with Regulations

The mare owner is responsible for all legal requirements, import permits, and duties, especially when shipping semen abroad.

6. Disclaimer

Budhen’s Stud only guarantees that the delivered semen is from the named stallion.
All other warranties, express or implied, are excluded.

7. Choice of Law & Jurisdiction

  • Belgian law applies.

  • Jurisdiction: Bruges, Belgium.

8. Entire Agreement

This contract replaces all previous agreements. Changes only in writing and signed by both parties.

9. Severability Clause

If individual provisions are invalid, the rest of the contract remains valid.
