PREAMBLE

The breeder declares that he has a legal interest in the mare described above and is entitled to breed her to the stallion EMERALD J during the breeding seasons 2026, 2027, and 2028.

1. BREEDING FEES

1.1 Breeding Fee

€ _______ (plus 6% VAT).

The breeding fee must be paid in full before the arrival of the mare at Jadem Arabians or before shipment of the semen, unless otherwise agreed in writing.

The breeding fee includes up to two breeding doses of frozen semen.
Transport costs and costs for rental containers are not included.

The breeding doses must be used no later than the end of the 2028 breeding season. After that, they lose their validity unless a written extension has been agreed.

Payment must be made before shipping to the account of JADEM ARABIANS
(bank details see last page).

1.2 Additional Breeding Doses

Additional doses can be purchased up to a maximum of 6 doses.

Price: € 300.00 per dose (plus 6% VAT).
Payment in full before shipment.

A breeding dose consists of eight 0.5-ml straws with a total of 800 million to 1 billion sperm .
The quality exceeds the industry standard minimum requirements.

1.3 Rebreeding Fee

€ 500.00 (plus 6% VAT), subject to the conditions according to Section 4.

1.4 Transport

All transport and shipping costs must be paid in full before shipping.

2. BOARDING FEES

€ ___ per day (plus 21% VAT)

  • € 18.50 (plus 21% VAT) – Mare without foal

  • € 22.00 (plus 21% VAT) – Mare with foal

All costs incurred during the stay (care, maintenance, damages, losses) are borne by the breeding customer.

Invoices are due immediately upon request.

3. BOARDING CONDITIONS

Veterinary Measures

The breeding customer agrees to all veterinary, farrier, and other measures that Jadem Arabians deems necessary, and expressly waives the right to contest them.

Disclaimer of Liability

The mare owner bears all risks of illness, injury, death, or damage.

Jadem Arabians is not liable for:

  • Illnesses or death

  • Accidents or injuries

  • Risks during loading, stabling, or insemination

  • force majeure (Force Majeure)

4. REBREEDING CONDITIONS

4.1

A repeat breeding is only possible if:

  • no pregnancy occurs or

  • no live foal is born.

A live foal must stand and suckle within 24 hours.

4.2

The mare must be examined 60 days after insemination.
The result must be communicated in writing within 10 days.

If this is omitted, all claims expire.

4.3

In the case of abortion, stillbirth or death of the foal, a veterinary certificate must be submitted within 30 days, confirming:

  • Vaccination against rhinopneumonitis in months 5, 7 and 9

  • proper health condition of the mare

The responsibility for submission lies exclusively with the mare owner.

4.4

Repeat breeding rights apply only for the immediately following breeding season.
A change of mare requires the written consent of Jadem Arabians.

5. GENERAL CONDITIONS

5.1 Death or Breeding Unsuitability

a) Stallion dies / becomes unusable:
The mare owner may choose another stallion from Jadem Arabians.
No live foal guarantee for subsequent years.

b) Mare dies / becomes unusable:
The breeding fee remains with Jadem Arabians.
A substitute mare may be presented with consent.

5.2

The contract is not transferable.

6. NOTIFICATIONS

Notifications are made in writing by registered mail.

7. AUTHORITIES & BREEDING ASSOCIATIONS

The mare owner is responsible for all permits, taxes, and regulations, especially for the transport of semen from Belgium.

8. OTHER STALLION

Breeding by another stallion renders the contract invalid, payment claims remain.
Jadem Arabians may, in this case, refuse foal registration.

9. DISCLAIMER OF WARRANTY

Jadem Arabians exclusively guarantees that the semen is from the named stallion.
All other warranties are excluded.

10. NON-TRANSFERABILITY

Rights and obligations may only be transferred with written consent.

11. CHOICE OF LAW & JURISDICTION

Belgian law applies.
Jurisdiction is Antwerp (Commercial Court).

12. ENTIRE AGREEMENT

This contract supersedes all previous agreements.
Changes only in writing and signed by both parties.

13. SEVERABILITY CLAUSE

Invalid clauses do not affect the validity of the remaining contract.
