Breeding Terms for ELLE MUSTIQUE (AHRA #684992):

Breeding Season: 2026
This agreement entitles the use of cooled or frozen semen from Elle Mustique during the 2026 breeding season.

1. Stud Fee:

  • The stud fee according to auction is to be paid in full.

  • The breeding is not transferable and not for resale.

  • No refund is possible after shipment of semen.

  • The breeding is considered fully fulfilled after two seasons.

2. Rebreed – Conditions:

A rebreed will only be granted if the following conditions are met:

  • The mare does not become pregnant in the current breeding season or does not produce a live foal.

  • A live foal is defined as a foal that stands and nurses within 24 hours after birth.

  • A written certificate from a licensed veterinarian must be submitted to TCA within 30 days of the loss being determined.

  • This certificate must confirm the following:

    1. The mare was vaccinated against EHV (Rhino) in the 5th, 7th, and 9th month of pregnancy.

    2. The mare was in good health (including vaccinations and deworming).

  • The rebreeding is only valid for the next breeding season.

  • A mare substitution must be approved in writing in advance by TCA.

3. Additional Fees (plus stud fee):

  • Semen collection & processing (per shipment / per mare)

  • Shipping costs:

    • FedEx or UPS: according to actual expense

    • Counter-to-counter shipping: $150

    • Airport courier fee: $150

    • Shipping to Canada: international fees and health certificate as applicable

  • Own FedEx number (optional): ____________________________

  • Late return of the Equitainer: $25 per day

  • Loss or damage of the Equitainer: $400

  • Processing fee for rebreeding: $500

4. Availability of Semen:

  • Breeding season: March 1 to July 1, 2026

  • Collection days: Monday, Wednesday, Friday (except on holidays)

  • Order: at least 24 hours in advance

  • No guarantee for quality/condition after leaving the farm

  • Shipping takes place according to availability and in order of receipt of orders

  • The stallion may participate in shows during the season – availability is at the discretion of TCA

  • Use only for the named mare. Any other use will result in immediate termination of the contract and liability for damages.

  • Mares that do not become pregnant after three estrous cycles must be examined for breeding suitability.

  • If a contagious disease is detected, TCA may refuse to cover the mare.

  • If the stallion is not available, a substitute stallion may be offered.

5. Law & Jurisdiction:

  • The law of the State of Alabama (USA) applies.

  • The courts in Alabama have exclusive jurisdiction.

6. Disclaimer:

Ted Carson Arabians LLC, its employees, agents, veterinarians, farriers, and the stallion owner accept no liability for:

  • Illness,

  • Epidemic,

  • Theft,

  • Injury or death of the mare or foal.

The use of semen is at the owner's own risk. It is the responsibility of the mare owner to obtain appropriate insurance.

No liability for direct or indirect damages.

Maximum liability is limited to the amount of the stud fee.

7. Validity & Amendments:

  • This contract is the complete agreement between the parties.

  • Amendments only in written form and with the consent of both parties.

  • Contract is not transferable and not for sale.
