PREAMBLE

The breeder declares that he has a legal interest in the mare described above and is entitled to breed her to the stallion SHAMS AL DIN AA in the breeding seasons 2026, 2027 and 2028.

The mare owner undertakes to attach a copy of the mare's registration papers to this contract.
In the event that the mare is housed at Jadem Arabians, a separate boarding contract must be signed prior to the arrival of the mare.

1. BREEDING FEES

1.1 Breeding Fee

€ _______ (plus 6% VAT).

The breeding fee must be paid in full before the mare arrives at Jadem Arabians or before the semen shipment leaves Jadem Arabians , unless another written agreement has been made.

The coverings must be used no later than in the years 2026, 2027, or 2028. After that, they lose their validity unless a written extension is agreed.

Payment is to be made to the account of Jadem Arabians bv.

1.2 Processing Fee

€ 125.00 (plus 21% VAT) per required processing for semen transport.

This fee must be paid in full before the semen leaves Jadem Arabians.

Not included are:

  • Transport costs

  • Cool box

  • Administrative costs

  • Health certificate

  • Shipping costs

The processing fee must be transferred to the account of Jadem Arabians bv.

1.3 Rebreeding Fee

€ 500.00 (plus 6% VAT), subject to the conditions according to section 2.

A rebreeding is only valid if the mare is attended at a recognized insemination center.

The stallion manager reserves the right, in the case of a mare that does not become pregnant after three estrous cycles, to require a bacteriological examination or biopsy to determine breeding suitability.

The stallion manager is entitled to discontinue breeding services if the mare is found to have an infectious or contagious disease or if there is another valid reason.

In this case, the mare owner is obliged to provide a replacement mare in order to fulfill the contract conditions.

The stallion manager provides semen from the stallion named in the contract and assumes no guarantee for the condition of the semen once it has left the premises.

The mare owner is responsible for the proper handling, storage, and insemination of the semen.

Neither the stallion owner nor the stallion manager is liable for lost, delayed, or damaged semen.

2. REBREEDING CONDITIONS

2.1

The rebreeding conditions (e.g. live foal guarantee) apply if:

  • no pregnancy occurs or

  • no live foal is born,

provided that all of the following conditions are met.

A live foal is a foal that stands and nurses unassisted within 24 hours after birth.

Applications for rebreeding in the following breeding season require a written certificate from a licensed equine veterinarian.

2.2

The mare must be examined for pregnancy 60 days after insemination.
The result must be submitted in writing within 10 days to Jadem Arabians.

If this is not done, all rebreeding rights automatically expire.

2.3

In case of pregnancy loss, stillbirth, or death of the newborn foal, a veterinary certificate confirming the following must be submitted within 30 days:

a) proper vaccination against rhinopneumonitis (EHV-1/4) in months 5, 7, and 9
b) appropriate health status of the mare including vaccinations and deworming

Responsibility for submitting the certificate lies exclusively with the mare owner.

2.4

The rebreeding right applies only to the immediately following breeding season.
A change of mare requires the written consent of Jadem Arabians .

3. GENERAL CONDITIONS

3.1 Death or Breeding Unsuitability

a) Stallion dies or becomes unsuitable for breeding:
The contract will – if frozen semen is available – automatically be converted into a frozen semen contract.
If no frozen semen is available, the mare owner may choose an equivalent stallion from Jadem Arabians.
No live foal guarantee for subsequent years.

b) The mare owner acknowledges that there is no guarantee of the fertilizing capacity of the semen.

c) Mare dies or becomes unsuitable for breeding:
A substitute mare may be provided within the same breeding season, subject to the approval of Jadem Arabians.

d) A fresh semen dose from an SBS-accredited laboratory contains at least 1 million sperm with at least 50% total motility and 30% progressive motility.

This contract applies to one (1) covering and one (1) certificate for one (1) foal.
All payments are non-refundable.

4–10. FINAL PROVISIONS

The mare owner is responsible for all official and studbook regulations, in particular for permits for semen transport from Belgium.

Covering by another stallion renders the contract invalid, payment claims remain. Jadem Arabians may refuse foal registration.

All warranties except those expressly stated are excluded.

The contract is not transferable or resalable.

Belgian law applies, place of jurisdiction is Antwerp (Commercial Court).

This contract constitutes the entire agreement. Amendments only in writing.

Should any clause be invalid, the remainder of the contract remains effective.
