Auction Terms – Horses

1. Organizer and Purchase Contract

European Breeders Trust AG (hereinafter "Organizer") organizes the online and live auction and acts in the name and on behalf of the respective seller. The purchase contract is concluded exclusively between the seller and the highest bidder. By participating in the auction – on-site or online – the bidder acknowledges the following auction terms as binding.

All information about the auction horses is provided to the best of our knowledge. However, the organizer assumes no liability for the accuracy of the information. Errors or misunderstandings do not entitle the buyer to withdraw, as buyers are given sufficient opportunity to inspect the horses.

2. Registration and Export

All horses offered at the auction meet the registration requirements of the World Arabian Horse Organization (WAHO). The buyer bears the costs for export documents and export fees.

3. Veterinary Examination and Health Certificate

Each horse is examined by a veterinarian before the auction and receives a corresponding health certificate. For pregnant mares, an ultrasound examination is performed; the result is noted in the certificate. A copy of the health certificate can be viewed before the auction. On the day of delivery, each horse receives the required veterinary certificates for the destination country. The buyer bears the costs for these certificates as well as for transport. The organizer assumes no liability for later health complications, especially not for miscarriages.

4. Currency

All bids are placed in euros (€).

5. Bidding Errors and Disputes

The organizer is not liable for bidding errors. Doubts about the validity of a bid must be reported immediately. The organizer reserves the right to reopen a bid – even after the purchase contract has already been signed.

Disputes (e.g. identical bids, misunderstandings during the awarding process, technical problems) are decided by the organizer. This decision is final and binding for all parties. The organizer may reject bids or re-auction a Lot. The decision of the auctioneer is incontestable.

6. Withdrawal of the Buyer

If the buyer does not confirm the purchase – for example, by refusing to sign or revoking the sales confirmation for online bids – the horse may be auctioned again. The original buyer is liable for any shortfall in proceeds.

7. Purchase price, commission, and taxes

The purchase price consists of the hammer price and a 9% commission, each plus the statutory value-added tax (currently 19%).

Buyers with a valid EU VAT identification number will be reimbursed the VAT, provided they can prove intra-community transport. The prerequisite is that the export procedure begins in Germany and is completed within three months after full payment.

8. Transfer of risk and ownership

With the fall of the hammer, all risks and obligations pass to the buyer. From this point on, objections are excluded. The horses are sold in the condition in which they are presented. Claims must be made directly against the seller. The organizer assumes no liability for this.

Ownership of the horse passes to the buyer only after full payment of the purchase price.

9. Costs after the hammer

From the time of the hammer, the buyer bears all costs incurred, including transport, accommodation, veterinary services, and hoof care. From this point on, the buyer is responsible for care and stabling until collection.

10. Payment

The purchase price must be paid immediately after purchase in cash or by bank transfer. The organizer is entitled to accept payments and to take legal action in the event of default. The organizer is only liable in cases of intent or gross negligence.

11. Collection of horses

The purchased horses must be collected no later than October 31, 2025. In the case of late collection, the buyer bears the resulting storage and care costs.

12. Handover

The handover takes place exclusively after full payment of the purchase price.

13. Transport

If desired, transport can be arranged by the organizer. After full payment, return transport to the original stable will be arranged unless the buyer organizes their own transport. In this case, the horse must be collected no later than 28. September 2025, 5:00 p.m.

14. Program Changes

The organizer reserves the right to change the course of the auction. This includes the right to auction horses together, separately, or not at all.

15. Insurance

With the acceptance of the bid, all insurance coverage ends. Upon request, a life insurance policy can be taken out through our partner Jarvis Insurance. Representatives are available on site.

16. Choice of Law and Jurisdiction

German law applies to these auction conditions and all claims arising from them. The place of jurisdiction is Kempten (Allgäu), Germany.

In the event of a legal dispute, the prevailing party is entitled to claim reasonable attorney and court fees.
